A common question we receive is: “If a law enforcement officer asks to search me, my car, my backpack, my apartment, or my house, do I have to consent?”
The clear answer is yes, you can refuse to be searched by police.
You always have the constitutional right to say no when an officer asks permission to search your person or property. This is one of your fundamental rights.
If you refuse to be searched by police, one of two things will happen:
1. The officer will respect your refusal and not conduct the search.
2. If the officer believes they have legal grounds to search without your consent (such as probable cause or a warrant), they may proceed with the search despite your refusal.
In the second case, you’ll maintain your right to challenge the legality of that search in court. However, it’s important to understand that you gain no benefit from agreeing to be searched by police. Consenting typically waives your right to challenge the search later.
